These Terms and Conditions outline the inner workings of KWIKSWEEP, and our duty to you, the customer. These Terms and Conditions may be subject to change.
Kwik Sweep Ltd. (hereinafter referred to as “KWIKSWEEP”, “we”, “us”, “our” or “ours”) is a company incorporated in England and Wales, with company number 07241917 and with our registered office at Kwik Sweep, 45 Barrett House, 4 Victoria Road, London, NW6 6QG
By using Services you are confirming you have read these Terms and Conditions (“Terms”) and agree to be bound by them when you become a registered Customer of the Services and for as long as you continue to make use of them. These terms govern your access to and use of the Services and constitute a legally binding agreement between you and KWIKSWEEP.
If you do not agree to these Terms, you may not use the Website or the app.
Key Terms
“Account” means registering with KWIKSWEEP by providing certain mandatory and voluntary information.
“Customer” means an individual or a business that completes the KWIKSWEEP registration process.
“Customer Content” means information that a Customer provides about themselves, their profile or the details of a Job.
“Dispute” means a disagreement between the Customer and KWIKSWEEP that a Job has been satisfactorily completed.
“Force Majeure” means an event beyond the control of KWIKSWEEP which prevents compliance with any of its obligations under this Contract, including but not limited to:
1.1.1 act of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods);
1.1.2 war, hostilities (whether war be declared or not), invasion, act of foreign enemies, mobilisation, requisition, or embargo;
1.1.3 rebellion, revolution, insurrection, or military or usurped power, or civil war;
1.1.4 contamination by radio-activity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radio-active toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly;
1.1.5 riot, commotion, strikes, go slows, lock outs or disorder, unless solely restricted to employees of the Supplier or of his Subcontractors; or
1.1.6 acts or threats of terrorism.
“Job” means the work requested by the Customer.
“Payment Service” means any payment providers.
Eligibility and Responsibility
You must be 18 years old or older to use the KWIKSWEEP mobile apps to post or respond to Jobs, and we may ask for proof of age before you can register. We reserve the right to refuse to provide the Services to any individual, business or other entity at any time without explanation.
Use of the Services
As a Customer of the Services you agree to the following:
That your account is for your own business or personal use only. You may not authorise others to use your account. You may register only one account. You are responsible for keeping any registration details confidential including your password. You acknowledge that KWIKSWEEP is not responsible for any third party access to your account and the consequences thereof, howsoever caused.
Jobs can only be booked within the areas stipulated here: http://www.kwiksweep.com/Collection_service .
You are responsible and assume liability for all information and Customer Content that you add to the mobile apps.
You assume all risk when using the Services, including, but not limited to, any risks associated with interacting with other people.
You will not use the Services, or engage in any activity on the KWIKSWEEP website and/or mobile applications, in any way that:
Violates any local, national or other laws or regulations or any order of a court of relevant jurisdiction;
Uses any software, devices, scripts, robots or other means to access, scrape, crawl or spider any web pages or other of the Services;
Uses the KWIKSWEEP website and/or mobile applications for any commercial or other purposes that are not permitted in these Terms;
Promotes or enables illegal or unlawful activities;
Is intended to damage or interfere with the operation of the Services, including but not limited to the introduction of viruses, time-bombs, Trojan horses, cancelbots, worms, or other harmful or disruptive codes, components or devices;
Is in any way used in connection with spamming, spimming, phishing, trolling or any similar activities.
Account and Registration
In order to book a Job you must register and create an Account with KWIKSWEEP. This is done directly with the KWIKSWEEP mobile app. The app requires software versions equal or greater than Android 4.1 or IOS 6.0.
When you create an Account with KWIKSWEEP we ask you to provide information about yourself. You hereby declare that the information you provide is true, that it relates to you and is entirely accurate. At our sole discretion we may undertake to validate any identification, payment or other information you provide to KWIKSWEEP. We may use third party agencies to undertake this validation, and in accepting these Terms you accept KWIKSWEEP may take such steps to confirm your identity and other details you provide. We may reject the creation of an Account at our absolute discretion.
It is a condition of the use of KWIKSWEEP that you provide us with a phone number.
Booking Jobs
Customers must be over 18 in order to register and book Jobs.
As a KWIKSWEEP Customer you can create a Job. The Job will include a description, location and a price that is either predetermined by the KWIKSWEEP price list, or by the Customer agreeing to a quote they have requested from KWIKSWEEP. You may also upload photographs/Video relating to the Job and in so doing you agree not to submit photographs/video that are likely to offend.
The minimum charge for any Job is £50 inclusive of VAT.
KWIKSWEEP will only attend single-item Jobs once full payment for the Job is cleared.
The final price for Jobs quoted from a Customer photograph cannot be guaranteed until KWIKSWEEP arrives on site and assesses the amount to be collected. Any items not included in the photograph may be subject to extra charge (see outline of charges here: https://www.kwiksweepapp.com/pricing) In this event, the customer reserves the right to cancel the Job and receive a refund less the £25 deposit.
A multiple-item Job is only confirmed once a £25 deposit has cleared. The remaining balance of the Job will taken on the day of collection via a card terminal.
KWIKSWEEP endeavours to attend all Jobs within 24 hours of a Job being confirmed with a deposit, but waives its obligation in the event of “Force Majeure” (as outlined in Key Terms list)
KWIKSWEEP reserves the right to refuse collections of items that it deems to be hazardous. In this event, KWIKSWEEP reserves the right to withhold all monies paid by Customer for the Job.
Cancellation Policy
A full refund is offered to Customers in the event of cancellation if cancellation occurs no later than 48 hours before the collection.
If a Job is cancelled 48 hours or fewer before the time of collection, a refund is issued less the £25 deposit.
Payment Services
KWIKSWEEP may use Payment Services at our complete discretion to facilitate payment card processing. KWIKSWEEP will ensure that the Payment Services comply with such financial and other relevant regulations but will not be responsible for the performance of the Payment Services.
KWIKSWEEP does not directly hold payment card information.
KWIKSWEEP will be responsible for paying the fees charged by the Payment Services.
Disputes and Dispute Resolution
Loss or Damage
If the Customer suffers loss or damage to their property and attributes the loss or damage to KWIKSWEEP, the absolute limit on any damage claim that we accept from the Customer is £50.
Cancellation of Your KWIKSWEEP Account
You may cancel your KWIKSWEEP account at any time by giving us notice at info@kwiksweepapp.com Unless otherwise stated herein, all KWIKSWEEP Services will be cancelled within seven (7) days of receipt of notice from you.
Trademarks and Copyright
The KWIKSWEEP logo is a registered trademark of KWIKSWEEP Ltd. KWIKSWEEP respects trademark and copyright law and we expect our Customers to do the same.
